SELLER / VENDOR TERMS
1. Definitions
For the purposes of these Terms:
Auction House / Auctioneer – Tong’s Auction House.
Seller / Vendor – Any person or business entering goods for sale through Tong’s Auction House.
Buyer / Bidder – Any person or business registering to bid or purchasing goods.
Lot – Any individual item or group of items entered for sale.
Hammer Price / Sale Price – The price at which a Lot is sold, excluding Buyer’s commission and any other applicable charges.
Reserve – The minimum selling price specifically agreed between Tong’s Auction House and the Seller.
---
2. Seller Authority & Ownership
The Seller confirms that they are the legal owner of all goods entered for sale or have full legal authority to sell them.
The Seller confirms that goods are free from finance, charges, liens or third-party claims unless these have been disclosed to Tong’s Auction House in writing before entry.
Tong’s Auction House reserves the right to refuse any item or consignment at its discretion.
---
3. Acceptance & Entry of Goods
Once goods have been accepted by Tong’s Auction House, they may be catalogued, photographed, researched, stored, displayed, advertised and allocated to an appropriate live or timed auction.
Tong’s Auction House reserves reasonable discretion over:
Lot numbers and sale dates
Whether items are offered individually or grouped together
Catalogue descriptions and photographs
The order in which Lots are offered
Starting prices and bidding increments
Whether an unsold Lot is re-entered into a subsequent auction
Whether a Lot is offered through a live or timed auction
Tong’s Auction House may postpone or move a Lot to another appropriate sale where reasonably necessary.
---
4. Seller Commission & Charges
Seller commission is charged as follows:
Lots selling for £10 or less: Minimum commission of £2 per Lot.
Lots selling for more than £10: 20% of the Hammer Price.
Commission and any applicable or agreed charges will be deducted from the Seller’s proceeds before payment.
Additional charges may apply where applicable or agreed, including:
Storage
Specialist handling
Transport
Marketing or photography
Disposal
Other specifically requested services
Current charges may be amended from time to time. Any changes will apply to new consignments from the date the revised charges take effect.
---
5. Reserves
Any reserve must be specifically agreed with Tong’s Auction House.
A reserve is not automatically applied because a Seller has provided a valuation, estimate or preferred selling price.
Unless a reserve has specifically been agreed, a Lot may be offered without reserve.
Tong’s Auction House may advise a Seller where it considers a reserve unrealistic or no longer appropriate.
Where a Lot remains unsold, the Seller may be asked to reduce or remove the reserve before the Lot is re-entered into a subsequent auction.
---
6. Seller Warranties & Descriptions
The Seller must disclose all information reasonably relevant to the description, condition, authenticity and value of a Lot, including any known:
Damage or faults
Repairs or restoration
Reproductions or alterations
Questions concerning authenticity
Missing components
Ownership or provenance issues
The Seller confirms that information supplied to Tong’s Auction House is accurate to the best of their knowledge.
Catalogue descriptions, valuations and estimates are expressions of opinion and are not guarantees of value, age, attribution, authenticity or final selling price.
---
7. Unsold Lots & Re-entry
Unless otherwise agreed or notified, unsold Lots may, at the discretion of Tong’s Auction House, be re-entered into a subsequent live or timed auction.
Tong’s Auction House may recommend reducing or removing a reserve before re-entry.
Where Tong’s Auction House notifies the Seller that an unsold Lot is to be collected, it must be collected within 3 days of notification, unless another arrangement has been agreed in writing.
Goods cannot be stored indefinitely.
Storage and handling charges may apply to goods not collected within the required period.
Where goods remain uncollected for a prolonged period, Tong’s Auction House may take further reasonable steps in accordance with applicable law, including giving the Seller notice requiring collection and advising what will happen if the goods remain uncollected.
---
8. Withdrawal of Lots by the Seller
Once goods have been accepted and entered for sale with Tong’s Auction House, the Seller should not withdraw those goods without the agreement of Tong’s Auction House.
Where Tong’s Auction House agrees to the withdrawal of a Lot after entry, a withdrawal fee will be payable at 20% of the agreed reserve price, subject to a minimum withdrawal fee of £3 per Lot.
Where no reserve has been agreed, a withdrawal fee of £3 per Lot will apply.
The withdrawal fee applies to each individual Lot withdrawn and reflects the administration and work undertaken in accepting, handling and preparing the Lot for sale.
Any additional costs specifically incurred in relation to the Lot, including agreed specialist handling, transport, storage or other services, may also be payable.
A Lot cannot be withdrawn once it has been sold or where a binding sale has otherwise been concluded.
Any withdrawal fees, storage charges or other outstanding sums due may be deducted from monies otherwise payable to the Seller.
Where permitted by law, Tong’s Auction House may require outstanding charges relating to withdrawn goods to be settled before those goods are released.
Collection of withdrawn goods must be arranged in advance and completed within the timeframe specified by Tong’s Auction House.
Storage charges may apply where withdrawn goods are not collected within the agreed period.
By entering goods for sale with Tong’s Auction House, the Seller confirms acceptance of these Terms & Conditions, including the withdrawal provisions and charges set out above.
---
9. Post-Sale Offers
Where a Lot remains unsold, Tong’s Auction House may receive and communicate offers from prospective Buyers.
Where the Seller has given prior authority for Tong’s Auction House to accept offers within specified parameters, the Auction House may accept an appropriate offer on the Seller’s behalf.
Otherwise, the Seller may be contacted for approval before an offer is accepted.
Once an offer has been accepted and a binding sale concluded, the Seller cannot subsequently withdraw the Lot.
---
10. Seller Payments
Seller payments are normally made approximately 21 days after the relevant sale date, provided cleared funds have been received from the Buyer.
Payment dates are estimates and may be affected by circumstances including late Buyer payments, payment disputes or banking delays.
Tong’s Auction House reserves the right to withhold payment where:
Buyer funds have not cleared
Ownership is disputed
Authenticity is disputed
A transaction remains unresolved
A sale has legitimately been cancelled
Money is otherwise legitimately due to Tong’s Auction House from the Seller
Applicable commission and charges will be deducted before payment.
---
11. Risk & Care of Seller’s Goods
Tong’s Auction House will take reasonable care of goods accepted onto its premises.
Tong’s Auction House will not be responsible for loss or damage resulting from inherent defects, deterioration, fair wear and tear or circumstances outside its reasonable control, except where liability cannot lawfully be excluded or limited.

---
16. Late or Non-Payment
If payment is not received within the required period, Tong’s Auction House reserves the right, where appropriate, to:
Contact the Buyer requesting immediate payment
Refuse release of the goods
Cancel the sale
Re-offer or resell the Lot
Refuse future bidding registration
Recover reasonable losses, fees or costs arising from late or non-payment
Any deposit held may be applied against sums legitimately due, subject to applicable law.
---
17. Collection
Unless otherwise stated, purchased goods must be collected within 3 days of the auction closing.
Tong’s Auction House publishes collection dates and opening arrangements for each auction. Buyers are responsible for checking and complying with these arrangements.

Where goods remain uncollected for an extended period, Tong’s Auction House may take appropriate steps in accordance with applicable law, including giving notice requiring collection and advising the Buyer of the consequences of continued non-collection.
Where legally permitted, goods may ultimately be resold and the proceeds applied towards legitimate outstanding charges.
Any remaining balance will be dealt with in accordance with applicable law.
If legitimate costs exceed the proceeds available, the Buyer may remain responsible for the outstanding balance where legally enforceable.
